1. Acceptance of Terms

By accessing or using the SitEatGo platform (the “Service”), operated by SitEatGo, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including restaurant owners (“Merchants”), restaurant staff, and customers (“Diners”).

2. Description of Service

SitEatGo is a digital ordering and restaurant management platform that provides:

• QR code-based digital menus for dine-in and takeaway ordering
• Online payment processing via integrated payment providers
• Kitchen Display System (KDS) for real-time order management
• Table management and QR code generation for Merchants
• Analytics and reporting dashboards
• Customer order tracking and notifications

3. User Accounts

You may need to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Merchant Terms

Merchants who register their restaurant on SitEatGo agree to:

• Provide accurate restaurant information, including menu items, descriptions, pricing, and allergen/dietary data
• Fulfill orders placed through the platform in a timely and professional manner
• Comply with all applicable food safety, hygiene, and licensing regulations in their jurisdiction
• Maintain an active and valid payment account with our payment processing partner for receiving payouts
• Ensure that prices displayed on SitEatGo are accurate and consistent with in-restaurant pricing unless otherwise disclosed

5. Diner Terms

Diners who place orders through SitEatGo agree to:

• Provide accurate information when placing orders
• Pay the full amount for orders, including any applicable taxes, tips, and fees
• Collect takeaway orders within a reasonable time or be present for dine-in service
• Inform the restaurant of any allergies or dietary requirements before confirming an order

6. Payments and Billing

Payment processing on SitEatGo is facilitated by Stripe, a third-party payment processor. By making a payment, you also agree to Stripe's Terms of Service.

All prices are displayed in the local currency of the restaurant. SitEatGo does not handle funds directly—payments are processed through Stripe and settled directly to the Merchant's connected Stripe account, subject to applicable platform fees.

Refunds are subject to the Merchant's refund policy and may be issued at the Merchant's discretion through the SitEatGo platform. Platform fees may not be refundable.

7. Intellectual Property

The Service, including its design, features, code, and content (excluding user-generated content), is the property of SitEatGo and is protected by copyright, trademark, and other intellectual property laws.

Merchants retain ownership of their menu content, branding, and images uploaded to the platform. By uploading content, Merchants grant SitEatGo a non-exclusive, worldwide license to display and distribute that content solely for the purpose of operating the Service.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or harvest data from the Service without authorization
• Impersonate another person or entity, or misrepresent your affiliation with a restaurant
• Submit false orders, fraudulent payment information, or fake reviews

9. Limitation of Liability

To the maximum extent permitted by law, SitEatGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

SitEatGo acts as a technology platform connecting Diners with Merchants. SitEatGo is not responsible for the quality, safety, or legality of food prepared and served by Merchants, nor for the accuracy of menu information provided by Merchants.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may also delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will remain in effect.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. SitEatGo makes no warranties, express or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users via email or in-app notification.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which SitEatGo is incorporated, without regard to its conflict of law provisions.
